Scott McCullough and Richard Sorin recently prevailed at the Tennessee Court of Appeals for a "Fortune 500 Company" Defendant manufacturer. The Tennessee Court of Appeals affirmed the trial court's judgment granting the Defendant's Motion for Summary Judgment. Specifically, the Court agreed with Defendant's position that the Defandant manufacturer was a statutory employer under Tennessee Worker's Compensation Law, and therefore immune from suit in tort, despite the presence of a service contract purportedly identifying the Plaintiff as an independent contractor.
